The coniitas Europaca and the control it imposes on national conflicts of law only exist

within the scope of'Community law. More particularly, as the economic freedoms have

been taken as the primary source of the negative side of the impact of Community law,

the preliminary question is whether universality could and should be considered a

measure 'capable of hindering directly or indirectly, actually or potentially, infra-Community

trade". If an obstacle to trade is the result, it follows that the universal application

of the lex fori conairsus is only allowed if it can be shown to be necessary for the

protection of overriding interests which have been recognised as taking precedence

over the economic freedoms.
