I o the extent that rules of distribution purport to protect the same interests as involved

in deployment, the answer must be the same as above: whereas value maximisation

raises no particular concern under Community law, interests of an economic nature,

States a degree of inconsistency within their laws. - Therefore, even if it is accepted

that only the goal of value maximisation for the benefit of creditors could justify

obstacles to trade caused by the law of deployment, separate distributional policies

should still be examined on their own merits.
